By accessing or using Forbify’s services (“Services”) or website (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please refrain from using our Site or Services.
2. Services Overview
Forbify provides multi-format content creation and distribution services to enhance brand visibility and authority across online platforms. We reserve the right to change or discontinue any part of our Services without prior notice.
3. User Responsibilities
Eligibility: You must be at least 18 years old to use our Services.
Accurate Information: You agree to provide and maintain accurate and up-to-date information during registration or engagement with our Services.
Account Security: You are responsible for keeping your account information secure and for any actions performed under your account. Notify us immediately in case of unauthorized access.
4. Intellectual Property
Ownership: All materials on the Site, including text, logos, and multimedia content, are the exclusive property of Forbify or its licensors.
Limited License: Forbify grants you a non-exclusive, non-transferable license to access and use the Site and Services for personal or business purposes.
5. Payments, Subscriptions, and Refunds
Payment Terms: All fees are listed in U.S. dollars (USD) and are subject to change. Payments are made upfront, with recurring charges processed automatically based on the agreed subscription.
Taxes: Any applicable taxes will be added to the fees during checkout.
Payment Failure: Failure to process a payment will result in a suspension of Services until payment is received.
Refund Policy: Refunds are only provided if legally required. All payments are otherwise final.
6. Campaign Setup and Deliverables
Our services begin once the payment is processed. Deliverables will be scheduled and distributed according to your campaign plan. Monthly or recurring campaigns will continue unless canceled prior to the renewal date.
7. Disclaimer and Limitation of Liability
No Guarantees: Forbify provides its Services “as is” without guarantees on specific results. While we aim to boost brand visibility, organic traffic improvements can vary.
Limitation of Liability: Forbify shall not be liable for any indirect, incidental, or consequential damages, including lost profits, even if advised of such risks.
8. Termination and Suspension
We may suspend or terminate your access to Services for any breach of these Terms. Any unpaid fees will remain due, and access to our Services will cease upon termination.
9. Governing Law
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law principles.
10. Modifications to Terms
Forbify may update these Terms from time to time. Changes will be communicated via the Site. Continued use of the Services constitutes your acceptance of the revised Terms.
11. Dispute Resolution
Any disputes arising under these Terms will first attempt to be resolved through negotiation. If unresolved, disputes will be referred to arbitration in Alberta, Canada.
